Attorney General Jon Bruning applauds the passage of LB 738 which creates the “Exploited Children’s Civil Remedy Act”. This legislation is modeled after a Florida law that is a civil remedy for the victims of child pornography. It provides victims with the means to stand up against the exploiters of such pornography.
This act allows the victims to file a civil lawsuit against anyone who creates, distributes or acquires child pornography while in the state of Nebraska. The minimum dollar amount set for damages is $150,000. Those 16 years of age and older and who voluntarily participate are not eligible to file a suit under this act.
